Terms of Service

please read this before ordering to avoid problems!

BY ORDERING ANY COMMISSION, YOU AGREE TO THE TERMS OF SERVICE
Exceptions will be made when discussed with ME prior to the commission

Please ask me about anything if there is something that you are unsure about or it isn't clear to avoid any problems and confusion, as well as misunderstandings and false accusations.
However, it is YOUR responsibility to ask if there was any doubt.

[i] GENERAL terms

Please write in a clear and nice manner, as to the best of your ability.
Clear image references will always be preferred to text references.
You may be charged extra if no image references are provided, please try to avoid walls of text for reference.Any ill or rude behavior will not be tolerated and your commission will be canceled if it occurs. If poor behavior is seen during the commission after the payment, the payment will not be refunded.I have the right to decline your commission if the following above criteria is not met, and/or I feel uncomfortable with the commission.

A lot of the things I will not draw is mainly due to how comfortable I am with drawing them as well as my art styles restriction or my lack of experience.*I will have the right to use fanart works for myself and allow others use for non profit. Please check [V] COPYRIGHT AND USAGE POLICY

[II] payment

Payments are generally done upfront before the commission is started. In very rare cases may I ask for payment at a different stage of the commission instead.All payments must be done through PayPal.
Accepted currency is USD.
Will accept AUD, however listed prices are in USD and will require the AUD equivalent of the prices.Invoices will be sent through PayPal after all the details are discussed.
You will receive a confirmation message from me when I have sent the invoice and when your payment has successfully come through.
Invoices not paid within a week will be retracted and the commission will not go further until recontacted. I may choose to decline the commission at that point.
In the case where invoices cannot be paid within the week and you are aware please let me know so we can arrange a more suitable date.
Please also let me know if there is an error regarding the invoice, for example it has not reached you, so we can try fix the issue.

[iiI] process

I work based off a first come first serve term GENERALLY, unless arranged otherwise (e.g. rush commission)
I may work on many projects at once.Commissions will not be started until the payment is received.discussion + confirmation → payment → sketch + revision → near complete + minor revision → deliveryCommissions may take up from a few days to several months. If needed by a certain date, please check by me if it will be possible to get it delivered on time.
Please hold an understanding that I am also human too and may have interferences with work, but will do my best to deliver on time if deadline exists.There is a high chance that I will stream the process on Twitch. If you wish for me to work in private please let me know. References given that includes any IRL reference such as photos of you or whoever you are commissioning for will not be shown on stream.

[Iv] customer satisfaction

I will do anything and everything I can in order to make my customers satisfied as long as it is reasonable.
I am human and I can't make everyone happy sometimes :cFinished products cannot be fixed, aside from minor mistakes and changes.Bigger changes that consists of any redraws of parts, will be charged extra, depending on how much is being changed unless it was my mistake from misinterpreting. However, I will always try to make ideas clear before starting the commission and/or during the sketch phase.Please make note of any mistakes and needs to add or fix during the sketch and near finished revision to make the process easier and smoother for both ways :D The sooner pointed out the better.

[v] copyright / usage policy

I have the rights to retain copyright on all my works.
I have the rights to use the work I produced however I want, unless agreed otherwise. (Such as private commission)Please give credit to the artist when reposting the work when you can.
This includes the mentioning of my name and a link to either my instagram and/or twitter/X.I will have the rights to:
Post/publish it anywhere to my liking.
Use it to promote myself (portfolios)
Display it wherever I wish.
I will not resell the work or put it on merch to sell to others without prior permission.Commercial use means to use with the purpose of gaining a profit such as reselling, printing on merch etc.The commissioner is allowed to:
Use the work for personal use and not for commercial use unless agreed otherwise.
Allowed to repost the work with full credit to the artist.
Print, for NON-COMMERCIAL use
Edit to use for banners, overlays etc.The following is restricted and considered copyright infringement unless agreed/given permission otherwise:
Use for commercial merchandising purposes.
Use for NFTs or reselling.
Taking credit for the creation of the work.
Editing/altering the work. (Unless small edits for personal use that won't comepletely change the work)
Not giving full credit when reposting.You are always welcome to ask or clarify any details about the use of the commission.Any sort of infringement will cause your commissioned piece to be retracted from any rights of use and will be blacklisted for future commissions.

[vI] cancelling / refunding policy

I hold the right to cancel and refund you the money for the commission anytime.
This may be due to personal issues where I may not be able to complete it for a long time. It could also be due to sudden circumstances that makes me uncomfortable in making the commission.
If possible I will always give the option to choose between a refund or a longer wait time.The commissioner is able to cancel the commission before payment/started.
The commissioner will not be allowed to demand for a refund, unless the full price has not been paid yet.
If there is an emergency where a refund is needed, please let me know first to make arrangements. Please also note that the full amount may not be refunded (mostly due to paypal fees or if the commission has been started)If you file a charge back, I will retract everything you have ever received from me and I will have full rights to do ANYTHING with them.
I will not hesitate to call you out publicly and blacklist you from my services.
I also have every right to file a complaint and keep the money for myself.
