Terms of Service

please read this before ordering to avoid problems!

BY ORDERING ANY COMMISSION, YOU AGREE TO THE TERMS OF SERVICE
Exceptions will be made when discussed with ME prior to the commission

Please ask me about anything if there is something that you are unsure about or it isn't clear to avoid any problems and confusion, as well as misunderstandings and false accusations.
However, it is YOUR responsibility to ask if there was any doubt.

[i] GENERAL terms

Please write in a clear and nice manner, as to the best of your ability.
Clear image references will always be preferred to text references.
Text references** will be charged extra** between 5-15 USD depending on complexity.
Please try to avoid walls of text.You will not be penalised if there are translation errors.
I will only speak in English and very basic Korean (with a lot of errors)Any ill or rude behavior will not be tolerated and your commission will be canceled if it occurs. If poor behavior is seen during the commission after the payment, the payment will not be refunded.I have the right to decline your commission if the following above criteria is not met, and/or I feel uncomfortable with the commission.
(Reason for declining will be given)

A lot of the things I will not draw is mainly due to how comfortable I am with drawing them as well as my art styles restriction or my lack of experience.*I will have the right to use fanart works for myself and allow others use for non profit. Please check [V] COPYRIGHT AND USAGE POLICY

[II] payment

Payments must be paid upfront before the commission has started for my security.All payments must be done through PayPal.
Accepted currency is USD.
Will accept AUD, however listed prices are in USD and will require the AUD equivalent of the prices.Invoices will be sent through PayPal after all the details are discussed.
You will receive a message from me when I have sent the invoice and when your payment has successfully come through.
Invoices not paid within a week will be retracted and the commission will not go further until recontacted. It is up to me whether I will continue or not.
If invoices cannot be paid within the week and you are aware please let me know so we can arrange a more suitable date.
Please also let me know if there is an error regarding the invoice, for example it has not reached you, so we can try fix the issue.

[iiI] process

I work based off a first come first serve term GENERALLY.
I may work on many projects at once.Commissions will not be started until the payment is received.You will only receive work in progresses when asked, or when I have questions to ask regarding the commission.
Requests to see the sketch before continuing will be allowed only when asked when ordering.Commissions can take up from a few days to several months depending on several factors. This is generally from school, family, health, emergencies etc. and yes I do have a social life.You are free to ask for updates and remind me when in doubt, especially after 3 or more months. However please do not spam me for updates and ask reasonably.There is a high chance that I will stream the process on Twitch. If you wish for me to work in private please let me know. References given that includes any IRL reference such as photos of you or whoever you are commissioning for will not be shown on stream.

[Iv] customer satisfaction

I will do anything and everything I can in order to make my customers satisfied as long as it's reasonable. I am human and I can't make everyone happy.Finished products cannot be fixed, aside from minor mistakes and changes.
E.g. color fixes and small marksBigger changes that will make me redraw any part, will be charged extra, depending on how much is being changed unless it was my mistake from misinterpreting something simple. However, I will always try to make ideas clear before starting the commission.Please tell me of any changes as soon as possible to make it an easier process bothways.

[v] copyright / usage policy

I have the rights to retain copyright on all my works.
I have the rights to use the work I produced however I want, unless agreed otherwise. (Such as private commission)Please always give full credit to the artist when reposting the work.
This includes the mentioning of my name and a link to either my instagram, twitter or deviantart.I will have the rights to:
Post/publish it anywhere to my liking.
Use it to promote myself.
Display it wherever I wish.
Use it in books or zines as examples and to showcase my work.
I will not resell the work or put it on merch to sell to others.
(with the exception of above)Commercial use means to use with the purpose of gaining a profit such as reselling, printing on merch etc.The commissioner is allowed to:
Use the work for personal use and not for commercial use unless agreed otherwise.
Allowed to repost the work with full credit to the artist.
Print, for NON-COMMERCIAL use
Edit to use for banners, overlays etc.The following is restricted and considered copyright infringement unless agreed/given permission otherwise:
Use for commercial purposes.
Use for NFTs or reselling.
Taking credit for the creation of the work.
Removing the watermark/signature on the work.
Editing/altering the work. (Unless small edits for personal use that won't comepletely change the work)
Not giving full credit when reposting.Any sort of infringement will cause your commissioned piece to be retracted from any rights of use

[vI] cancelling / refunding policy

I hold the right to cancel and refund you the money for the commission anytime.
This may be due to personal issues where I may not be able to complete it for a long time. It could also be due to sudden circumstances that makes me uncomfortable in making the commission.
If possible I will always give the option to choose between a refund or a longer wait time.The commissioner has no right to demand for a refund or take back the commission, unless the full price has not been paid yet.If you file a charge back, I will retract everything you have ever received from me and I will have full rights to do ANYTHING with them.
You will be blacklisted and forbidden to order from me ever again.
I will call you out, spread your name to public and all the social media I have for others to watch out for.
I also have every right to file a complaint and keep the money for myself.
